Constitutional or Hogwash? Pt 1
A few weeks ago I did a video on the topic of lawsuits to prevent Obama from taking office, but since there have been some changes so I wanted do an update. Ill have to present this in two parts so that I can devote the time to each section that it deserves. Introduction So, basically weve got two different kinds of lawsuits questioning the legality of a Barack Obama presidency. Lets call them, the Native Born But Not Natural Born camp and the Not Even a Legal Citizen camp. Ill handle the Not Even a Legal Citizen camp in Part II. Native Born But Not Natural Born Leo Donofrio sued the NJ Secretary of State Nina Wells, claiming that the State had not properly vetted presidential candidates. He had a good point, because one of the candidates on the ballet was born in a foreign country to parents who were not US citizens. However, his suit was dismissed in Appellate Court because, they said, the State was not responsible for making these determinations. Donofrio made an application to the Supreme Court but was dismissed earlier this month. He helped co-write another lawsuit by Cort Wrotnowksi that also was dismissed by the Supreme Court (SCOTUS) this month. Donofrio claims that Obama does not meet the requirement to be a Natural Born citizen because at birth he held dual citizenship. This is because Obamas father was a native of Kenya, which at the time was a British colony. This left young Obama with both a US and a British citizenship until the age of 21. Donofrios underlying assertion is that someone with dual citizenship does not meet the definition of Natural Born Citizen, because it would leave him with split loyalties and that would have been something the founding fathers would have tried to prevent. This is a really interesting premise because the meaning of the term Natural Born isnt really defined by the Constitution or by any subsequent set of laws. In fact, the term is used only once in the Constitution. The oft-quoted 14th Amendment does little to clarify this. The provisions in Section 1 of the 14th Amendment have been interpreted to the effect that children born on United States soil, with very few exceptions, are U.S. citizens. This type of guarantee is legally termed jus soli, or "right of the territory". However, it does not clarify whether or not citizenship is equal to being a natural born citizen. Whatever meaning the term natural born citizen had for the founding fathers is certainly no longer clear. Prevailing legal opinion over the last 100 years, however, has held that anyone born on US soil, except to parents with foreign diplomatic status, is a natural born citizen. Since Obama did not try to maintain his British citizenship at the age of 21, he lost it. This would effectively remove the concern about split loyalties and I wonder what impact this situation would have on the case. It would have been interesting to find out. Interestingly, Donofrios case highlighted the fact that there is no governmental body responsible for specifically verifying a candidates eligibility for Presidency. This is clearly an opportunity for some enterprising lawmakers to streamline the process and, perhaps, prevent future difficulties.
